A puppy sales contract is not a means of control, it is an instrument by which the expectations and
responsibilities of the
individuals entering into the contract. The Buyer and Seller
are
clearly established and those expectations and
responsibilities concerning the
life, care, health, and well-being of the dog are
clearly delineated.
In addition, this contract serves as an important
tool
to help ensure the best future for the puppy
that we, the Seller, have bred and
you, the Buyer have chosen.

The
following agreement is between Lori
Elrod (breeder), hereafter referred to as "Seller,"
and ,
hereafter referred to as "Buyer". We, the Buyer
and Seller, by our signatures below, acknowledge our understanding of,
agreement with, and intention of compliance with the terms and conditions of
this Contractual Agreement for the Sale and Conveyance of the following puppy:

2. Financial Terms:
In consideration of a purchase
price of $_____________ dollars, paid-in-full,
the Seller
transfers, in fee simple, all rights, privileges, and responsibilities
associated with
3. Health Guarantee:
The puppy is
healthy at the time of sale. The puppy has had the immunization(s) provided in
the vaccination record (attached). Vaccinations must be kept current or the
guarantee is void regarding said puppy. Should the puppy become ill or unsound,
any and all cost of treatment will be the responsibility of the Buyer and not
reimbursed by the Seller. The Buyer acknowledges that no veterinary bill
incurred by the Buyer will be paid by the Seller throughout the puppy’s life.
The full purchase
price of this puppy will be refunded if the Buyer furnishes the Seller with a
certificate from a licensed veterinarian of the Seller’s choosing indicating
that the puppy has a life threatening congenital defect or virus, and returns
the puppy to the seller within 72 hours of delivery. In
the event a refund is granted, the amount of the refund will be the purchase
price of the puppy only and will be refunded within 30 days of granting the
refund. No veterinary, transportation, or any other expenses
incurred by the buyer will be reimbursed
by Seller.
The Seller does not
guarantee against communicable diseases beyond 72 hours of Buyer receiving the
puppy. The above puppy is guaranteed for one year from the date of birth
against death caused by a genetic defect or any other congenital defect that
would be life threatening to the dog. The diagnosis must take place within the
first year by a licensed veterinarian of the Seller’s choosing for this claim
to be valid. Any and all documents as well as proof of the claim is to be sent
to Seller within 72 hours of that diagnosis and claim.
If the claim is for
the death, all documents from the Seller’s licensed veterinarian, a formal
autopsy, and a cause of death will to be sent to Buyer. If the claim occurs
within the first year and the claim is valid, the pup will be replaced with a
pup of equal value and of the same gender as pups are available, with the Buyer
being responsible for all transportation costs. Seller does not guarantee
against avoidable disease caused by improper care or neglect by the Buyer.
Seller does not guarantee the size of the puppy’s adult weight. This guarantee
is void if the puppy/dog changes ownership without the consent of the Seller.
4. Conditions Regarding Return, Re-Sale, or
Re-homing of Dog:
Buyer agrees that if any time, and for any reason,
he/she is unable to keep or properly care for the puppy, Seller will assume
ownership (i.e. first right of refusal) of the dog in this contract.
The Buyer shall not sell the
puppy, or its offspring (if any), to any individual or establishment in the
business of buying and selling puppies for a profit. If it is found that above dog has been re-homed without notification,
surrendered or sold to a pet store, wholesale outlet, dog pound/shelter or
rescue organization Seller reserves the right to take immediate repossession of
the dog. If the dog is found to be abused or neglected the Seller reserves the
right to take immediate repossession.
5. Expected Care of the Dog:
The Buyer agrees to maintain the puppy’s health at the
Buyer’s expense with yearly vaccinations
and care as specified by their veterinarian and will include heartworm preventative,
flea and tic preventative, a good diet, and a clean, safe, and healthy
environment.
6. Spay/Neuter Requirements:
The
above puppy is to be spayed or neutered before one year of age. Failure to do
so will result in the immediate repossession of the referenced dog and
forfeiture of all funds paid to date.
7.
Limitations and Exclusions:
Buyer acknowledges that the need for care and benefits
of training are acknowledged by the Buyer to be his or her responsibility. No
other warranties or guarantees, expressed or implied, are made under this
contract except as stated above.

The
following agreement is between Lori
Elrod (breeder), hereafter referred to as "Seller,"
and
hereafter referred to as "Buyer".
We, the Buyer and Seller, by our signatures below, acknowledge our
understanding of, agreement with, and intention of compliance with the terms of
this Holding Agreement.
1. In consideration of a total of $_________________________ dollars, paid-in-full,
which
is
considered as Surety of Action, as prepayment, and as deposit, the Seller
assigns the Buyer the option to acquire the puppy described below.
2. Further, the Seller guarantees
that the puppy will not be sold to any party other than the Buyer identified in
this agreement and that this agreement will remain in effect for a period of
_____ days.
3. At the time Purchaser acquires
physical possession of the dog, the sum total of the amount of the deposit/prepayment/Surety
of Action listed above shall be applied to the purchase price with a balance of
$_______________ dollars to be paid at the time the Buyer
assumes possession and ownership of the referenced puppy. The sum of the
deposit/ Surety of Action/prepayment and balance owed (itemized above)
represents the full, agreed upon purchase price of $_________________ dollars. In addition, a charge totaling $_______________ will be added to pay
for shipping and handling resulting in a total owed of $_________________ (price of dog + shipping and handling –
deposit/prepayment/Surety of Action).

5. The
Buyer assumes all responsibilities for the dog as of the date and time of this
agreement. The Seller will not be held responsible for illness and/or injury to
the dog except where that illness and/or injury would have been avoided by the
exercise of reasonable and normal care.
We the
undersigned have read, understand, and agree with the terms of this Holding
Agreement. All funds are non-refundable.
